Special prosecutors in Albania asked lawmakers on Tuesday to lift the parliamentary immunity of former president and prime minister Sali Berisha to allow for him to be placed under house arrest.

Seventy-nine year-old Berisha, the pre-eminent political figure in Albania after the fall of communism in the early 1990s and again in the 2000s, was charged in October alongside his son-in-law with “passive corruption” dating to 2008.

Claiming he is the victim of a political vendetta, Berisha has since flouted a so-called ‘security measure’ requiring him to report to police twice a month.

On Tuesday, the Special Prosecution Against Corruption and Organised Crime, SPAK, said it asked “for the granting of authorisation for the arrest/deprivation of liberty through the replacement of the security measure”. Berisha would then be placed under house arrest, SPAK told BIRN.

The charges against Berisha stem from a change of legislation by his then government in 2008 to allow the privatisation of sports facilities expropriated under communism.

Prosecutors say this was one of a number of legal changes undertaken by Berisha’s government to facilitate business developments in which he and his son-in-law, Jamarber Malltezi, had a financial interest. Prosecutors allege the men together reaped some 5.4 million euros in kickbacks.

Malltezi was arrested while Berisha was banned from leaving Albania and ordered to regularly report to police.

Berisha, however, accused the prosecutors of acting under the orders of Prime Minister Edi Rama, whose Socialist Party is arch-rival to the Democratic Party once led by Berisha.

If found guilty, Berisha faces spending between four and 12 years in prison.

In 2021, the United States accused Berisha of involvement in “significant corruption” and declared he was no longer eligible to enter the US.
