Bulgarian court acquits Ahmed Dogan in conflict of interest case

A five-judge panel of Bulgaria's Supreme Administrative Court (SAC) found controversial politician Ahmed Dogan innocent on charges of conflict of interest in a case that saw him receive a one million euro consultancy fee from state-owned electricity utility NEK.

The panel confirmed the earlier ruling of a three-judge panel and cannot be appealed further. In its reasoning, the court said that Dogan's consultancy contract was signed before January 1 2009, when the Bulgaria's law on conflict of interest went into force, even though part of the payment was carried out when the law was already in effect.

The contract in question was signed between Dogan and the private Institute of Mining with the help of Minstroy Holding, one of the subcontractors at the Tsankov Kamuk hydro-power array, developed by NEK at a total cost estimated at 460 million euro.

Dogan is the leader of the predominantly ethnic Turk Movement for Rights and Freedoms (MRF), which nominally held the Government mandate in 2005/09, when Bulgaria was governed by a Socialist-led tripartite coalition that included MRF.

"The claims that a member of Parliament could influence political decisions in his role as mandate-holder during this period and as the leader of a political party are outside legal considerations and do not prove the real possibility of the person under investigation of exercising influence, using his power, to acquire the respective benefit," the court said.

The SAC chose to disregard Dogan's campaign speech from 2009, when he told voters that he was "an instrument of power" and could greatly influence the distribution of state funds.

"The court must find violations by following strictly defined procedural rules and proof admissible by law – parliamentary session protocols, contracts, equity statements and written proof of money transfer," the court said.

Former Bulgarian chief prosecutor implicated in murders

SOFIA, Bulgaria -- Interior Minister Tsvetan Tsvetanov said on Tuesday (November 16th) that former Bulgarian chief prosecutor Nikola Filchev may be linked to two murders committed in 2000 and 2002. Tsvetanov said that an investigation is under way into the killings of prosecutor Nikolai Kolev and lawyer Nadezhda Georgiev. The latter was killed in her Sofia home in February 2000. Witnesses claim she received $150,000 to give to Filchev as a bribe to make him terminate an investigation against a state-owned company. When she failed to hand it over, however, he allegedly plunged a kitchen cleaver into her head.

Kolev, a high ranking prosecutor who served as deputy chief prosecutor of the country between 1994 and 1997, was shot dead outside his home in December 2002. He had publically stated his opinion that Filchev suffered from a psychiatric disorder, committed crimes and ordered criminal proceedings based on fabricated charges against people he found inconvenient. The National Assembly has rejected a proposal made by members of the Order, Law and Justice party (OLJ) and the Coalition for Bulgaria, that Interior Minister Tsvetanov should explain before Parliament his earlier comments that former prosecutor general Nikola Filchev was possibly involved in the murder of prosecutor Nikolai Kolev and Yambol lawyer Nadezhda Georgieva, Bulgarian media reported on November 17 2010.

New accusations have been made in the nepotism scandal between two of Bulgaria's prominent ethnic Turkish politicians.
On Friday, Vezhdi Rashidov, a renown Bulgarian sculptor of Turkish origin and Culture Minister in the center-right government of the GERB party, revealed that Deputy Chair of the centrist ethnic Turkish party DPS (Movement for Rights and Freedoms, which was part of the governing coalitions in 2001-2009), Lyutvi Mestan, had helped his relatives take advantage of Culture Ministry funds in the city of Kardzhali.

Bulgaria Businessman Gone Missing

Police are working on six possible scenarios regarding missing businessman Kiro Kirov, aged 70, one of which was that he had been kidnapped, prosecutor Plamen Panayotov told Bulgarian BTA news agency.

Kirov disappeared on March 27 at about 9pm. His relatives called the police on the following day.

According to police, Kirov parked his luxury vehicle in the garage of his house in Sofia’s Bankya neighbourhood. His relatives found it with its doors open. Kirov’s two mobile phones have been switched off since Friday.

On Sunday, private national broadcaster Nova Televisia quoted Kirov’s son, Ivan Kirov, who said that his father had called him and told him that he was abroad, but without saying when he was returning to the country.

Kirov PLC is a famous name in the construction business in Bulgaria; the company is involved in import and sales of earthmoving and construction equipment.
