Kronzeuge Agim Zogaj, im Fatmir Limaj Prozess, hat in Duisburg Selbstmord begannen

Der unter Zeugenschutz stehende Agim Zogaj, dessen Name erst nach dem Tod bekannt wurde, hätte unter anderem gegen Fatmir Limaj, einst einer der Kommandeure der terroristischen Kosovo-Befreiungsarmee UCK und heute populärer Politiker und Parlamentsabgeordneter, aussagen sollen.



Limaj steht unter Verdacht, während des Kosovo-Konfliktes Kriegsverbrechen gegen die serbische Bevölkerung begangen zu haben, und sitzt seit 22. September auf Beschluss eines EULEX-Richters unter Hausarrest. Ein Prozess gegen ihn und neun mutmaßliche Mittäter soll im Oktober beginnen.

Prishtina - Der Kronzeuge in einem im Kosovo bevorstehenden Kriegsverbrecherprozess gegen den früheren Verkehrsminister Fatmir Limaj ist tot. Wie die Tageszeitung "Zeri" unter Berufung auf die EU-Rechtsstaatsmission EULEX auf ihrem Internetportal berichtete, sei die Leiche von Agim Zogaj in einem Park in Deutschland aufgefunden worden. Weitere Details waren zunächst nicht bekannt. Die Todesursache soll von den deutschen Behörden untersucht werden. Zogaj war geschützter Zeuge der Anklage und war bisher unter dem Tarnnamen "Zeuge X" bekannt. ...

Witness in ex-KLA trial fears for safety, won’t testify

BELGRADE -- A potential witness of the prosecution in ex-Kosovo Liberation Army (KLA) commander Fatmir Limaj has said that he does not want to testify for safety reasons.

The witness informed the deputy prosecutor on Thursday, after learning of protected witness Agim Zogaj’s death, that he did not want to testify in the Klečka case for safety reasons.
“The Serbian War Crimes Prosecution believes that justice in the region is jeopardized by Agim Zogaj’s death and expresses concern over the information that Zogaj, a protected witness in the EULEX Prosecution’s case against Fatmir Limaj, was found dead in a park in Duisburg, Germany,” it was announced on Thursday.

The Serbian prosecution stressed that its 2008 investigation against Limaj and 28 more KLA members had greatly contributed to EULEX Prosecution’s case.

Aside from Limaj, the EULEX indictment charges nine more persons with war crimes against Serb and Albanian civilians in the village of Klečka in 1999.

A key witness in a war crimes trial in Kosovo has been found dead in Germany. He had apparently committed suicide.
Nicholas Hawton, an EU spokesman in Kosovo, said on Wednesday Agim Zogaj's body was discovered in a city park in Duisburg, reports Associated Press.

Police believe that he hanged himself late on Tuesday.

"He committed suicide. There are no indications for a different explanation," police spokesman Stefan Bauer said, adding that an autopsy will be carried out on Thursday.

Zogaj was a protected witness in the trial of Fatmir Limaj. The ethnic Albanian and former transport minister under Prime Minister Hashim Thaci is suspected of unlawfully killing and torturing Serb prisoners during the 1998-99 Kosovo war. Many of the charges were based on Zogaj's witness statements.

Zogaj’s death will not affect the trial because the court will have his recorded testimony, assured the EU’s mission in Kosovo, which is responsible for the prosecution of Limaj.

Last week, the former commander of the Kosovo Liberation Army was put under a month-long house arrest by a judge of the EU Rule of Law Mission pending his trial for war crimes.

He was cleared of similar charges by a UN court in 2005 which ruled there was insufficient evidence to convict him.

Limaj, who remains an influential political figure in Kosovo, is also under investigation over alleged embezzlement of budget money during his time in the cabinet.

Der erneut wegen Kriegsverbrechen angeklagte kosovarische Politiker Fatmir Limaj kann seinem für Oktober angekündigten Prozess nun gelassen entgegensehen

Dass nach der NATO-Invasion des Kosovo das Organisierte Verbrechen die Macht übernahm, lässt sich unter anderem aus einer geleakten Verschlusssache des Bundesnachrichtendiensts ersehen. Praktisch alle politischen Akteure in diesem Gebiet sind eng mit entsprechenden Strukturen verwoben. Ministerpräsident Hashim Thaci soll den Erkenntnissen des Europarats nach sogar in den Handel mit Organen von Angehörigen der serbischen Minderheit verstrickt sein, die in manchen Fällen lebenden Opfern entnommen wurden.
Bei Prozessen in Den Haag kam bisher praktisch nichts gegen albanische Kriegsverbrecher heraus. Das lag auch daran, dass Zeugen sich plötzlich nicht mehr erinnern konnten oder verstarben. Im Fall des freigesprochenen Ex-Premiers Ramush Haradinaj kamen beispielsweise von zehn Belastungszeugen neun bei Gewaltakten oder Verkehrsunfällen ums Leben und einer zog nach einem Anschlag auf ihn seine Aussage zurück. Ein Effekt, den man auch aus der Geschichte des Organisierten Verbrechens in anderen Ländern kennt.
Nun wurde bekannt, dass der Kosovo-Albaner Agim Zogaj, der als Kronzeuge in einem Prozess gegen den ehemaligen kosovarischen Verkehrsminister Fatmir Limaj aussagen sollte, tot in einem Park in Deutschland aufgefunden wurde. Zogaj war als Teilnehmer eines Zeugenschutzprogramms in die Bundesrepublik eingereist, was ihm aber möglicherweise nichts half, da auch hier albanische Mafia-Gruppen seit den 1990er Jahren sehr aktiv sind.

THE HAGUE, Netherlands -- UN chief war crimes prosecutor Carla del Ponte and the heads of the intelligence services in three Balkan countries met in secret in The Hague on Tuesday (October 9th) to discuss possible actions aimed at arresting four remaining high profile war crimes fugitives: Radovan Karadzic, Ratko Mladic, Goran Hadzic and Stojan Zupljanin. Dnevni Avaz reported on Wednesday that BiH Intelligence-Security Agency General-Director Almir Dzuvo attended the meeting, along with Serbian counterpart Rade Bulatovic and Montenegrin counterpart Dusko Markovic. Tomislav Karamarko, head of Croatia's state security service, had to miss the meeting because of official business in the United States. EU Officers 'Blocked' by Kosovo Police During Arrest

Police officers from the EU rule-of-law mission, EULEX, were stopped by their Kosovo colleagues early on Wednesday as they tried to arrest the police chief in Prizren.

Pristina Nexhmi Krasniqi, the head of the police station in the southern Kosovo town, surrendered to the EULEX officers two hours after they attempted to arrest him but were blocked by Kosovo policemen.
Two other men were arrested by EULEX police on Wednesday as part of the same operation.
EULEX stated today that the arrests were authorised by a EULEX pre-trial judge of the District Court of Pristina. The mission claimed that the three persons arrested today were detained based on war crimes suspicions.
Balkan Insight has learned that EULEX police and the First Intervention Team, FIT, part of the Kosovo police, entered Nexhmi Krasniqi's office in Prizren early on Wednesday in order to arrest him.
“They entered around 9am but policemen from the station became angry and blocked the station, locking all the doors,” a source from Kosovo police told Balkan Insight.
“Kosovo policemen did not allow EULEX officers to arrest commander Krasniqi and closed all the doors. EULEX and FIT members left the building,” the source told Balkan Insight.
According to the source, Krasniqi surrendered two hours later.

EULEX should make an announcement regarding Limaj later today.

Limaj, former Kosovo transport minister and current deputy leader of the ruling Democratic Party of Kosovo (PDK) turned himself in to the EULEX police last night at his home in Čaglavica near Priština.

He told reporters as he was leaving the house that he was "proud he took part in the war and in building Kosovo after the war."

Limaj also said he would answer to judicial bodies even though he believed they were wrong.

His arrest followed after yesterday's arrest of former KLA members in Prizren and other towns in Kosovo.

After two-hour questioning the former KLA commander was released. According to the media, the judicial proceeding will continue in the next several days.

“We have responded to the court subpoena and came to EULEX, Limaj said he would cooperate with the judiciary. He is going back home, to his family now,” Limaj’s attorney Tom Gashi stated.

The former KLA commander had already been put on trial in the Hague Tribunal but he was acquitted. B92 has learned that even though Limaj had been acquitted by the Hague Tribunal, the domestic prosecution has a court permission to conduct an investigation into the Klečka camp and one more locality.

Serbian War Crimes Prosecution has welcomed EULEX’s effort regarding investigation into the crimes committed against non-Albanians in Kosovo. Their latest operation is a result of a good cooperation between EULEX and Belgrade prosecutors who have been conducting the investigation into the events in the two KLA camps which were commanded by Limaj for three years now.

Ex-KLA in warning
Organizations of the former so-called Kosovo Liberation Army (KLA) members urged on Wednesday the EULEX mission to stop its "hunt" against them and expressed opposition to the Mališevo and Lipljan arrests.

Accusing EULEX of "provoking a situation full of tensions in Kosovo", the ethnic Albanians organizations, which refer to themselves as "war veterans", said that EULEX "lost its reputation in the eyes of Kosovo citizens".

"The KLA and its liberation struggle are internationally recognized. Demonization of the KLA fight by EULEX clearly shows the cooperation that this mission has with genocidal Serbia and its associates within Kosovo," said in a statement in the wake of war crimes arrests.

Fakten wie diese zeigen erneut, wo der Kosovo in Wirklichkeit steht! Im absoluten Rechts Null und total kontrolliert von den kriminellen Horden der Deutschen SPD Mafia und FES, welche ja alle Warnungen vor ueber 10 Jahren ueber diese Todes- Gangster Schwadronen ausschlugen. Parnter des Amts Versagers und Betruegers Joschka Fischer und Tom Koenig ebenso, wie von Bodo Hombach, dem Geschaeftemacher auf dem Balkan, wie von Rezzo Schlauch und den gut bekannten Deutschen Bestechungs Firmen im Schlepptau.
Die Mafia Geschaefte u.a. direkt auch von Gerhard Schroeder auch in Rumaenien um Nastase fuehren bis heute zu Verhaftungen und Anklagen. Ein Sammelbecken von menschlichen Muell, was sich im Visa Skandal entlud. Der selbe Firmen Bestechungs Schrott der Politik, ueber die Lobby Vereine auch noch mit Entwicklungsgelder finanziert, der auch Griechenland ruiniert hat.

A number of lucrative building contracts appear to have gone to friends and relatives of Fatmir Limaj – and to companies whose experience in the field appears to be limited.
Companies associated with Kosovo’s Transport Minister, Fatmir Limaj, are among those that made big profits from Kosovo’s huge road-building programme in the past two years.
An investigation by BIRN’s Balkan Insight has uncovered that some firms, handed multi-million euro road-building contracts, also appear to have had little experience in the relevant field.
Balkan Insight has also established that two multi-million euro tenders issued to a friend of Limaj’s ought to have been disqualified, as the firms failed to provide the necessary documentation.
Balkan Insight has looked at every significant road tender issued by the Ministry of Transport and Post-Telecommunications since 2007. Using this information, from Kosovo’s official register of businesses, we have compiled a list naming the firms that won the 50 most lucrative contracts, the value of the tenders, the owners of the winning firms, the dates of the companies’ creation and the size of their workforces.
Transport ministry official Endrit Shala has dismissed the list as the work of an “intelligence agency”, however, and has claimed its publication formed part of a campaign to discredit Limaj.
The same official said he had records of the movements of Balkan Investigative Reporting Network journalists, the people they had met and the documents they had collected. When asked to explain the statement, he declined to elaborate.
The Ministry of Transport did agree to open its files on tenders to Balkan Insight, although it later refused to allow the newspaper to look at the offers submitted by companies.
We asked for an interview with Minister Limaj, but he declined. Instead, Endrit Shala, chief of cabinet at the ministry and Limaj’s right-hand man, said the minister had played no part in tenders awarded to his friends. He added that given Kosovo’s small size, it was no surprise that “somebody knows someone”.
“The tender process of the Ministry of Transport is very transparent. We respect all of the rules and procedures of the procurement rules of Kosovo,” Shala said.
Limaj, a former high-ranking member of the Kosovo Liberation Army, KLA, was tried but cleared of all charges at the International Criminal Tribunal for former Yugoslavia, ICTY, in 2005. One of the most popular politicians in the governing Democratic Party of Kosovo, PDK, he has been dogged by unsubstantiated accusations of corruption.
Our investigation established that Limaj’s ministry awarded two large contracts to a close friend, Habib Morina, and handed the second-largest contract to date for a road-building project, worth 11 million euro, to another friend, his relative, Colonel Haxhi Shala.
Morina told Balkan Insight his relationship had played no role in the tender processes while Col Shala said he was no longer an employee of the company, Delia Group, which won the contract

But our research shows that more than one-third of the winning tenders were issued to firms that only registered after Limaj took up his position.
Given the poor state of roads at the time, the minister’s dynamism and “no-nonsense” approach has attracted plaudits. An anti-corruption NGO, Cohu, in July 2008 noted that he had “undertaken great efforts to build new roads”.

TIRANA, Albania – The EU wants Albania to resolve its political stalemate by May 10th, for the good of the country’s integration processes. The ruling Democratic Party and the opposition Socialist Party have been at odds for months over the June 2009 general elections. The EU needs facts not promises, Spain’s Ambassador to Tirana – Manuel Montobio – said on Tuesday (April 27th), prior to sending his quarterly report on the country. Spain holds the rotating EU presidency. May 10th is the date of the meeting between EU and Albanian officials, on the country’s Stabilisation and Association Agreement.
