Kosovo Police Pull Back From Serb Border

Kosovo special police have pulled back from two border crossings in the Serb-dominated north of the country following an agreement beween Pristina and Belgrade.
Lawrence Marzouk

Kosovo’s special police unit has withdrawn from border points within the Serb-held north of the country following orders from the government, a police source told Balkan Insight.

The source added that a deal had been reached between Pristina, Belgrade and KFOR, details of which are expected to be announced in a press conference later.

Kosovo Police, however, according to Interior Minister Bajram Rexhepi, remains in control of the two customs points and Kosovo Customs have been deployed there.

Rexhepi told the Pristina daily Koha Ditore at 2pm that KFOR was working alongside Kosovo Police, adding that four officers from the special unit had been injured in the operation. One is believed to have been shot in the head and is in a critical condition.

According to reports in Pristina, members of the special units came under attack from local Serbs as they pulled out in the direction of the northern town of Mitrovica.

A loud explosion was reported in a neighbourhood of north Mitrovica, which is inhabited largely by Serbs.

Kosovo Police last night unilaterally seized control of the crossings, which have been controlled by the EU rule-of-law mission, EULEX, since Kosovo’s declaration of independence, in a move which has been condemned by Serbia and the international community.

The police were sent in after EULEX failed to enforce last week’s ban on the import of Serbian goods.

Europe's top official in Pristina criticised Kosovo this morning, saying Brussels did not see the action as helpful.

EU Special Representative Fernando Gentilini spoke hours after a special police unit took control of two border crossings with Serbia.

The operation "was not helpful. It was not done in consultation with the international community and the EU does not approve it," the top EU official said. "It is essential now to calm the situation down and return to where we were. EULEX stands ready to assist the Kosovo authorities in doing this.

"Unilateral action by one side or the other cannot solve the problem," he added.

The comment was later condemned by Pristina-based think tank, the Foreign Policy Club. In a statement, the club called Gentilini’s comments "unacceptable", adding that he appeared to be advocating a “return to unlawfulness”.

EULEX has controlled the disputed points since Kosovo declared independence in 2008, when local Serbs set fire to the border crossings near the towns of Leposavic and Zubin Potok.

Both the EU mission and KFOR, the NATO force in Kosovo, said they were not involved in the police operation, despite claims to the contrary by Kosovo Prime Minister Hashim Thaci.

As the operation got underway, Thaci announced that he had sacked the country’s top police officer, Reshat Maliqi. He is believed to have been sacked because of his reticence to go ahead with the operation, an international source told Balkan Insight anonymously.

Kosovo last week banned the import of all Serbian products. Belgrade placed an embargo on Kosovo goods following the 2008 declaration of independence, breaching the terms of the Central European Free Trade Agreement, CEFTA.

When talks between Belgrade and Pristina on resolving this issue failed last week, and the next round of EU-led negotiations was postponed, Kosovo introduced the ban.

But Kosovo's Interior Minister, Bajram Rexhepi, the man who ordered the police to seize the border points, said EULEX had failed to implement the decision, allowing Serbian trucks to enter Kosovo, resulting in the shock deployment.

The deal between Belgrade and Pristina to end the dispute is believed to have been brokered by KFOR, although Bekim Collaku, senior political adviser to Kosovo's Prime Minister, told Radio Free Europe at 2pm that no such deal had been reached.

Milivoje Mihajlovic, head of the Serbian government's information bureau, said his government wished to resolve the situation in north Kosovo.

“Kosovo and Metohija is under the protectorate of the United Nations and the international community and we have to try to indicate to the point of the problem in these centres of power through diplomatic channels and thus to try to solve the problem,” Mihajlovic told reporters in Belgrade.

“On the other side, we should do everything in the field in order to avoid any incidents,” he added.

"Kein Interesse an staatlicher Ordnung"

Trial Hears of KLA Terror Tactics

Former military attaché tells of kidnapped Serbs and of how paramilitaries treated Albanians believed to be loyal to the Serb administration.

…………………………………. …………….
Former attaché Colonel John Crosland – whose face was hidden from
public view by screens and image distortion, just as it was when he
testified against Slobodan Milosevic in July 2002 – told judges on
Thursday that clashes between the fledgling KLA and Serbian forces began
well before the Lapusnik camp is alleged to have opened, and intensified
through the course of 1998.

He also said the KLA regularly kidnapped ethnic Serbs in an effort
to terrorise the population, and attacked Albanians it suspected of
collaboration.
But while he spoke of training programmes, supply routes and
regional headquarters, he expressed some scepticism about the extent to
which the KLA had an organised command structure at the time.
Crosland’s testimony was largely made up of comments on a series of
“diplomatic telegrams” presented to him by the prosecution. The bulk of
these documents are still under seal, and two legal advisors of the
British government were present in the courtroom throughout his
testimony to ensure this measure was respected.
With reference to the events described in these reports, Crosland
told judges that even as early as March and April 1998, clashes between
Serbian forces and ethnic Albanian rebels in the Drenica Valley – a KLA
heartland - were spreading to the area around the border with Albania,
where the KLA was bringing in munitions and men along traditional
smuggling routes.
According to the diplomatic reports, by the second half of April,
western journalists were saying that the KLA virtually controlled areas
just over the border in Albania.
There were also indications that the KLA was operating training
camps in the Albanian towns of Tropoja, Bajram Curri and Kukes.
……………………
One diplomatic report presented by the prosecution noted that
kidnappings of Serbs had reached such a point that Serbs were beginning
to avoid travel around Kosovo.
“In October we estimated something like 200 Serbs were missing,
presumed having been kidnapped by Albanian elements,” Crosland told the
judges.
The witness also discussed media reports that the KLA had carried
out grenade attacks on businesses and restaurants in Pec belonging to
Albanians who were suspected of collaborating with the Serbs.
“These attacks… were similar to what went on throughout this
campaign, where Albanians who were seen to be siding with the Serb
administration were taken out and their businesses either bombed and
they themselves murdered,” Crosland told judges.
The trial continues.

Kosovo: Over & Out

WEDNESDAY, APRIL 20, 2011
Over & Out

In late 2005, after being in Kosovo for a few months, I sent a report – entitled “Strategic Thoughts” – to UNMIK HQ in Pristina. It drew two conclusions: that the Kosovo Albanians could not be kept from having their own independent state and that the northern Kosovo Serbs would never accept being incorporated into it.

In that paper, I argued that “Serbs in the north will not accept direct rule from Pristina or by any 'Albanian' institutions. They would simply 'opt out' of Kosovo since they are, functionally, still part of and contiguous to Serbia. Any attempt to impose such an outcome, sanctioned by Belgrade or not, could lead to some form of mass exodus and/or an effort to resist, including perhaps through partition and violence.”

Looking forward, I suggested that “the final status for northern Kosovo (the region including the three northern municipalities plus Mitrovica North) hopefully will be the result of negotiations between Pristina and Belgrade. However, from looking at the limited universe of successful (and unsuccessful) negotiations of tribal and ethnic conflict elsewhere, it seems that substantial local autonomy for the northern Kosovo municipalities would be an essential element of a stable and peaceful final settlement. This means K-Serbs in the north would essentially govern themselves within the context of the existing municipal governments and within an overall, Kosovo-wide decentralized political structure with some form of protected participation in national institutions…. The international community could not expect to integrate northern and southern structures if the idea is to ensure full compliance of the northern municipalities with Pristina. If we try, we will likely get nowhere and could instead contribute to a hardening of approaches on both sides. If our aim is instead to increase cooperation between northern municipalities and PISG, we may be able to achieve modest results if we focus on practical issues as free from politics as possible. But we will need more flexibility from K-Albanians, some degree of acceptance from Belgrade, and focused efforts from UNMIK to engage all significant K-Serb actors....We cannot dismantle parallel structures and ought not try. No matter what, these structures will remain in place because the K-Serbs require them in order to continue to function as a community.”

I recommended that UNMIK's strategic objective should be to “deliver a stable, peaceful and functioning community of four municipalities to a final overall political settlement,” and that our tactics should be dialogue with all parties.

It may be that those more influential than I have finally come to the same conclusion, as witnessed by the most recent ICG report,

    Dear Friend,

Albanians Stand at a Perilous Crossroad

    by Shirley Cloyes DioGuardi

On January 21, 2011, Albanians in Albania and across the globe were shocked when a protest in the capital of Tirana turned violent, leaving three dead and thirty-nine wounded.  The Socialist Party, chaired by Edi Rama, had conducted a door-to-door campaign to drive people into the streets after Deputy Prime Minister Ilir Meta, chairman of the Socialist Movement for Integration, was caught on tape trying to fix a public tender for a hydropower plant granted to one of his friends.  But the public reaction went far beyond two decades of stark division between the country’s reigning political camps.

By the time the violence was quelled, it was clear that the crowd of more than 20,000 represented a citizenry filled with pent-up anger about uninvestigated and unpunished corruption among the political elite and an ever worsening economic downward spiral for the majority of Albanians.  Last year the European Union rejected Albania’s application to become a member state, insisting that the country had to bring an end to corruption and establish rule of law and a viable democracy.  With the January 21st uprising, EU acceptance is unfortunately now more elusive than ever before.

The unresolved matter of the March 2008 ammunitions factory explosion in Gerdec, in particular, has been a festering wound for Albanians of all political persuasions, because it demonstrated that oligarchs in politics and business are exempt from the rule of law.  Twenty-six workers died and 309 were injured at the Gerdec plant, where they were prying open thousands of artillery shells with metal rods and bare hands on a daily basis as part of a national program to dismantle ammunition and sell their components.  It was later revealed that the explosions began when workers were moving old cartridges from China and Russia, amassed by the Communist-era dictatorship of Enver Hoxha, and that these stocks were being repackaged and sold to the Afghan Army and police forces.

To make matters worse, the money from this enterprise was being diverted to Albanian officials, including the son of Prime Minister and Democratic Party leader Sali Berisha, according to an investigative report conducted by The New York Times.  Although former Defense Minister Fatmir Mediu resigned, neither he nor any other government or company officials were charged with wrongdoing.  Instead, after the national elections on June 29, 2009, Mediu was reinstated in the government as the Minister of the Environment, a position that gives him immunity from criminal prosecution.

And so, even though the Socialist Party initiated the demonstration on January 21, they tapped into the sense of helplessness and hopelessness engulfing Albanians of all political persuasions in the face of endemic corruption on the part of the elite, lack of rule of law, and the failure of both Socialist and Democratic Party leaders to bring the nation out of poverty.

    Ex-Communists Still in Charge

Twenty years after the fall of communism, Albania is still run by former Communist
officials.  Their patronage and control of both business and media sectors makes it very

difficult for newcomers to enter politics.  Although more than 30,000 Albanian youth have graduated from universities in the West, most of them are either reluctant to return to Albania or are disappointed when they do.  Those who have tried to enter the political elite often end up turning into money-driven clones of older leaders in the Democratic and Socialist parties.  Tragically, they continue the pattern of confrontational politics, void of principles and values, which has thwarted national unity and progress ever since the Communist dictatorship fell in 1991.

The deadly riots of January 21 illustrate the degree to which the country is in the grip of two major parties locked in a bitter rivalry and a siege mentality that crowds out rational voices and squelches the idealism of young professionals who would like to make a difference.  This time, however, the Albanian electorate is unlikely to respond to the oligarchs, including both Prime Minister Berisha and Socialist Party Chairman Rama.  Instead, the growing frustration with the abuse of power by the self-serving elites will undoubtedly propel the Albanian people to return to the streets, hopefully without escalating into more violence.

The call for early elections will come soon, but unless conditions are created for new political leaders and new political parties that are not tainted by the last twenty years of embezzlement and hidden political party collaboration, it is hard to imagine a way forward.  It is essential that today’s corrupt politicians are replaced by a new political block rallied around democratic values and prepared to lead Albania into a productive future with the rest of Europe. And the Western officials currently en route to Tirana should do more than try to broker stability; they should support the Albanian population’s yearning for genuine democracy and economic viability.

The Marty Report:  A Slur on all Albanians

Meanwhile, Kosova, which has been marred by political instability since the fall of 2010, was recently brought to its knees when Swiss diplomat Dick Marty issued a 27-page report to the Council of Europe alleging that the Kosova Liberation Army (KLA) harvested organs from Serbs and Albanian collaborators during the war in 1999 and that Prime Minister Hashim Thaci was directly involved—assertions that were first made by UN Prosecutor Carla Del Ponti in her book in 2008.  Marty also made sweeping generalizations, calling Kosova a clan-based society engaged in smuggling drugs and other activities of organized crime.  Moreover, he suggested that authorities in Albania collaborated in the harvesting and trafficking of organs and later hindered proper investigation of Marty’s allegations.

Dick Marty would have us believe that NATO, the UN Mission in Kosova, EULEX (the European Union Rule of Law Mission in Kosovo), the International Criminal Tribunal for the Former Yugoslavia, Albania, and the entire international community, with the exception of Belgrade and Moscow, have waged a campaign for more than a decade to hide organ harvesting by Kosovars from Marty, Del Ponte, and Serbian President Boris Tadic.  Fortunately, even though the Parliamentary Assembly of the Council of Europe
approved Marty’s report on January 25, 2011, it called on local and international
authorities to launch investigations into Marty’s “suspicions of inhumane treatment of

people and illicit trafficking in human organs in Kosovo.”  On the same day, several members of the European Parliament stressed that Marty had yet to produce evidence to support his charges and that EULEX had asked him to do so for some time.

The charge of organ harvesting is an especially “lethal” attack on Kosovars and on all Albanians because organ harvesting is reminiscent of Nazi war crimes against Jews.  Nevertheless, it is simply the latest development in an orchestrated campaign on the part of Belgrade and its supporters in Europe to discredit Albanians, criminalize the KLA, and create a false parity between the perpetrators and the victims of the Balkans wars of the 1990s, in which 200,000 were murdered and more than 4 million displaced by the Serbian military and paramilitary troops.

Serbia knows that the responsibility for the crimes that its massive army perpetrated against defenseless citizens in Kosova can never be washed away.  Therefore, it is using the charge of organ harvesting to morally weaken the just Albanian cause for an independent Kosova and to raise doubts in the international community about its support for Kosova’s struggle to defeat the late Serbian dictator Slobodan Milosevic and his henchmen.  Serbia’s ultimate goal is to position itself for reopening negotiations about the status of Kosova with the aim of annexing northern Kosova.  This is why the Prishtina government should refuse to enter into new talks with Belgrade until Serbia apologizes to Kosova for Milosevic’s genocidal war against Albanians and recognizes Kosova’s independence, which was legitimized by the International Court of Justice last July.

Dick Marty also alleged in his report that Kosova’s Prime Minister Thaci is involved in the heroin trade.  Although there is not a shred of evidence to support this charge, there is plenty of evidence that Albanian political leaders have been enriching themselves at the expense of the people and allowing organized crime and corruption to flourish relentlessly.  Shamelessly officials have dipped into tenders for highways and other infrastructure projects, while two thousand Albanians are still missing since Kosova’s conflict, 45 percent are unemployed, and too many Albanians live in abject poverty.

There is also ample evidence that the Albanian political leadership has consistently taken a passive role, instead of a proactive one, in the face of Serbian attempts to discredit Albanians since war’s end.  For example, it was well known that Dick Marty began his investigation in the summer of 2008, and yet there was no attempt on the part of Albanian leaders in Prishtina and Tirana to anticipate and counter his false conclusions.

    Time for Change

Albanians in Tirana and Prishtina are now at a perilous crossroads, and it is time to recognize that the blame lies not just with Serbia and the West, but with the Albanian political leaders, who have enriched themselves beyond measure, while failing to properly govern and meet the needs of the poorest citizens in Europe.  If the current leadership is unwilling to bring an end to corruption and incompetence at the highest levels of government, then they must be asked to step down so that a new generation of professionally able and idealistic men and women can steer Albanians out of the economic and political morass in which they have lived for too long.

Albanian Kosovo dual citizenship after visa liberalization, now is became "De Facto" reality

Minister Beqaj: The Albanians of Kosovo can obtain passports from Albania

Kosovo government officials have not ruled out the possibility that a number of Kosovars of Albanian passports aiming device, after entry of Albania into the Schengen area.

As announced by Albanian embassy in Pristina, there are eight criteria that must be met to obtain a passport from Albania, including resident position of 5 years, 3 years respectively for the citizens of Kosovo.

Dismissed Minister of European Integration, Besim Beqaj saying history has shown that after the liberalization of visa regime with Serbia, some Kosovo Albanian and Serbian passports now the same could happen with Albania.

According to minister Beqaj, there were some cases when citizens of Kosovo are going to Serbia and have fictitious registration, taking Serbian passports to finish so in different countries of the European Union.

"This has shown that any block that is made, creates opportunities for them, to find alternative routes and this is the argument that we use every day," said Minister Beqaj.

Few days ago, European Union Commissioner for Internal Affairs, Cecilia Malmström has warned Serbia and Macedonia for "misuse of visa liberalization", citing the possibility of reviewing this process.

Muhamed Ali Gasi, one of Bosnia's most notorious gangsters, has had his jail term reduced on appeal.
Ali Gasi, 37, was sentenced last year to 20 years behind bars, but the term was cut by the Supreme Court of Bosnia's Croat-Bosniak (Bosnian Muslim) part on appeal to 17 years on Wednesday.
Seven other members of Gasi's gang, who had been tried with him last summer, received final sentences of between 22 months and four-and-a-half years.
The trial of Gasi and members of his gang, including his brother Aziz, is considered one of the most high-profile cases to have been brought in Bosnia.
Ali Gasi and his gang were believed to have been the most dangerous criminals operating in the country, police and officials working on the case told Balkan Insight.
Witnesses also described brutal methods he used to extort money from businessmen or force people to sell him valuable real estate significantly below its market value.
Prior to his arrest in January 2008, Gasi was considered untouchable and was often seen cruising in a red Ferrari sports car on the streets of Sarajevo.

Albanian fugitive wanted in gang violence, armed robberies arrested
(ANA-MPA) -- A 22-year-old Albanian national arrested on Monday in a Piraeus-area district is believed to be a member of an Albanian gang involved in a bloody turf war in the Greek capital two years ago as well as a perpetrator of numerous armed robberies of jewelry stores and break-ins of upscale residences in the greater Athens area.
The man is suspected of participating in the robbery of nine jewelry stores, where merchandise worth 500,000 euros was taken, as well as in the burglary of six residences.
Nine murders and at least 13 attempted homicides were attributed to the 2008 violence, which pitted mostly gangs of young Albanians nationals vying for slices for the drug trade in parts of central and west Athens.
The suspect was arrested along with a Romanian woman, 22, in the Piraeus working-class district of Drapetsona after a brief car chase. He had reportedly ignored a police patrol's indication to stop for a routine traffic stop.
Authorities found an assault rifle, a pistol, bullets, a bulletproof vest as well as 11,490 euros and US$4,300 in the vehicle, while a subsequent search of the couple's home revealed another assault rifle, three handguns, a large number of rounds, another bulletproof vest, suspected loot from previous robberies, cannabis and two precision scales.
